The Terms and Conditions (T&C) outlined below govern the use of www.yasa-studios.art (the Site). This Site is owned and governed by Yasa Art Studios. This Site is an e-commerce website.

By using this Site you indicate that you have read and understand these Terms and Conditions and agree to abide by them.

Intellectual Property

All content published and made available on our Site is the property Yasa Art Studios and the Site creator. This includes, but is not limited to images, videos, texts, documents, downloadable files and anything that contributes to the composition of this Site.

When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords and sensitive information attached to this account; and

  2. that personal information you provide to us through your account is up to date, accurate and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our site illegally or if you violate these T&C.


Sale of Goods and Services

The following Goods are available on the Site:

  • Paintings

  • Prints

  • Drawing paper

  • Brushes

  • Ink stones

  • Ink sticks

  • Liquid ink

  • Watercolours

  • Felt mats

  • Charcoals

  • Other art supplies materials which may be added in the future


The following Services are available on the Site:

  • Art commissions and image licensing.

 

These T&C apply to all Goods and Services that are displayed on the Site at the time you access it. That include products listed as out of stock. All information, description, images we provide about the goods and services is as accurate as possible. However, we are not legally bound by such information, descriptions or images and cannot guarantee the goods and services on our Site. You purchase the Goods and Services at your own risk.

 

Yasa Art Studios reserves the right to to modify, reject or cancel your order at out own discretion. If your order is cancelled after your payment has been processed, you will receive a full refund equal to the amount you paid to the payment method you initially used. It is your responsibility to ensure that your payment instrument is valid for receiving any such refund.

Your order is subject to checks and authorisation by your card issuer. If your card issuer does not authorise the payment, your order will be cancelled. In case of failed authorisation, your order can't be completed and Yasa can't be held liable for non-delivery or delay in delivery.


Third Party Goods and Services

Yasa offers goods and services from third parties. We cannot guarantee the quality and accuracy of goods and services made by third parties and available on our Site.


Payments

We accept the following payment methods on the Site:

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

 

If we believe that your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

 

Disclaimers

Artwork: all paintings are original, signed and sealed by the artist. All original artwork are sold mounted, unless specified otherwise.

Colour: please note that we apply our best efforts to make good images which best reflect real-life colours. However,, due to differences in devices, Yasa Art Studios can't guarantee an exact colour match of the artwork, prints, and art supply materials you purchase on the Site.


Links to Third-Party Websites

Our Site contains links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, practices of any third party website or service linked to our Site. It is your responsibility to terms and conditions and privacy policies of these third-party websites before using them.

 

Applicable Law

These Terms and Conditions are governed by the laws of the Republic of Malta.


Dispute Resolution

In case of dispute or disagreement between you and the Site owner, both parties shall try their best to reach a resolution by informal communication. In the event of failure to reach an agreement, all disputes shall be referred to the courts of the Republic of Malta.
